Nell’affrontare il tema dello ius variandi orizzontale l’A. dubita del corretto esercizio della delega, di cui al d.lgs. 15 giugno 2015 n. 81, qualora il nuovo art. 2103 comma 1 c.c. venga interpretato nel senso che il datore di lavoro non sia tenuto a tener conto dell’equivalenza delle nuove mansioni.

By addressing the issue of horizontal change of duties, the author doubts the proper exercise of the delegation of Legislative Decree no. 15 June 2015, n. 81, in case the new art. 2103, par. 1, of the c.c. is interpreted as if that the employer is not required to take account of the equivalence of new duties.
